1 Applicability to entrepreneurs and definitions

(1) The following General Terms and Conditions apply to all deliveries between us and a consumer in the version valid at the time of the order.

A consumer is any natural person who enters into a legal transaction for purposes that can predominantly be attributed neither to their commercial nor their self-employed professional activity (§ 13 BGB).

2 Conclusion of contract, storage of contract text

(1) The following regulations regarding the conclusion of the contract apply to orders placed through our online shop http://www.eclectic-handcrafts.de.

(3) The presentation of goods in our online shop does not constitute a legally binding offer on our part but is only an invitation to the consumer to order goods. By placing an order for the desired goods, the consumer submits a binding offer to conclude a purchase contract.
(4) Upon receipt of an order in our online shop, the following regulations apply: The consumer submits a binding offer by successfully completing the order procedure provided in our online shop. The order is made in the following steps:
  1. Selection of the desired goods.
  2. Confirmation by clicking the “Order” button.
  3. Review of the information in the shopping cart.
  4. Pressing the “Checkout” button.
  5. Log in to the online shop after registration and enter login information (email address and password).
  6. Re-checking or correcting the respective entered data.
  7. Binding submission of the order by clicking the “Order Now” or “Buy” button.
Before the order is finally submitted, the consumer can return to the page where the customer’s data is captured by using the “Back” button contained in their internet browser to review the information and correct any input errors or cancel the order process by closing the internet browser. We immediately confirm the receipt of the order by sending an automatically generated email (“Order Confirmation”). With this, we accept your offer.
(5) Storage of the contract text for orders via our online shop: We store the contract text and send you the order data and our terms and conditions by email. The terms and conditions can be viewed at any time at http://www.eclectic-handcrafts.de

You can view your past orders in our customer area under My Account -> My Orders.

3 Prices, shipping costs, payment, due date

The stated prices include the statutory value-added tax and other price components. Any additional shipping costs will be added. The consumer has the option of payment in advance, PayPal, credit card (Visa, Mastercard). If the consumer has chosen payment in advance, they are obliged to pay the purchase price immediately after the conclusion of the contract.

PAYMENT:

There is no minimum order quantity. Prices are valid at the time of ordering. Promotions on the website may be limited in time or quantity. Details can be found in the product description. The prices stated on the website are in euros and include VAT.

You can pay by credit card, PayPal, advance payment, Klarna instalment purchase, Klarna instant transfer, Klarna direct debit.

If you have chosen payment in advance, the bank details for transferring the purchase price are provided in the order confirmation.

The payment methods Klarna instalment purchase, Klarna instant transfer, and Klarna direct debit are offered in cooperation with Klarna Bank AB (publ), Sveavägen 46, 111 34 Stockholm (hereinafter referred to as “Klarna”). You make your payment to Klarna, to whom we assign your claim.

You will be automatically redirected to Klarna Checkout if you have chosen one of the mentioned payment methods.

Your personal data will be treated by Klarna in accordance with applicable data protection regulations and in accordance with the information provided in Klarna’s data protection information. You can find these at  https://www.klarna.com/de/datenschutz/

Klarna reserves the right to carry out an identity and credit check and may refuse to process a payment option in individual cases and refer to alternative payment options.

Use of PayPal
We use the PayPal payment service from PayPal (Europe) S.à.rl et Cie, SCA (22-24 Boulevard Royal L-2449, Luxembourg; “PayPal”) on our website. The data processing serves the purpose of being able to offer you payment via the payment service. By selecting and using payment via PayPal, the data required for payment processing will be transmitted to PayPal in order to be able to fulfil the contract with you using the selected payment method. This processing is carried out on the basis of Article 6(1)(f) of the GDPR) .

For individual payment methods such as credit card via PayPal, direct debit via PayPal, PayPal reserves the right to obtain credit information based on mathematical and statistical procedures using credit agencies. For this purpose, PayPal sends the personal data required for a credit check to a credit agency and uses the information received about the statistical probability of non-payment to make a balanced decision about the establishment, implementation or termination of the contractual relationship. The credit report can contain probability values (score values) that are calculated on the basis of scientifically recognized mathematical-statistical methods and whose calculation includes, among other things, address data. Your concerns will be considered in accordance with the statutory provisions. The data processing serves the purpose of checking your creditworthiness to initiate a contract. The processing is carried out on the basis of Article 6 Paragraph 1 Letter f of the GDPR due to our overriding legitimate interest in protecting against non-payment if PayPal makes advance payments. 

For reasons arising from your particular situation, you have the right to object at any time to this processing of your personal data based on Article 6 Paragraph 1 Letter f of the GDPR by notifying PayPal. The provision of the data is necessary for the conclusion of the contract with the payment method you require. Failure to provide this means that the contract cannot be concluded using the payment method you have chosen.

4 Delivery

(1) Unless otherwise expressly stated in the product description, all items offered by us are ready for shipment. The delivery will be made within 5 working days at the latest. The period for delivery begins in the case of payment in advance on the day after the payment order is given to the bank commissioned with the transfer, and for all other payment methods on the day after the contract is concluded. If the end of the period falls on a Saturday, Sunday, or legal holiday at the place of delivery, the period ends on the next working day.
(2) The risk of accidental loss and accidental deterioration of the sold item also passes to the buyer on delivery in the case of a mail-order purchase.

5 Retention of title

We reserve ownership of the goods until the purchase price has been paid in full.

6 Right of withdrawal of the customer as a consumer

Withdrawal Right for Consumers: Consumers have a right of withdrawal in accordance with the following provision, whereby a consumer is any natural person who concludes a legal transaction for purposes that can predominantly neither be attributed to their commercial nor their self-employed professional activity.

Right of withdrawal:

You have the right to withdraw from this contract within fourteen days without giving reasons. The withdrawal period is fourteen days from the day of the conclusion of the contract.
To exercise your right of withdrawal, you must inform us Eclectic Handcrafts by Claudia, by sending an Email to: [email protected] by means of a clear declaration of your decision to withdraw from this contract. You can use the attached sample withdrawal form, but this is not mandatory. To comply with the withdrawal period, it is sufficient to send the notification of exercising the right of withdrawal before the withdrawal period expires. Consequences of Withdrawal If you withdraw from this contract, we shall reimburse you for all payments we have received from you, including delivery costs (except for the additional costs arising from your choice of a type of delivery other than the cheapest standard delivery offered by us), without undue delay and no later than fourteen days from the day on which we received notification of your withdrawal from this contract. We will use the same means of payment for this refund as you used for the original transaction, unless expressly agreed otherwise with you; in no case will you be charged any fees for this refund.
If you have requested that the services should begin during the withdrawal period, you shall pay us a reasonable amount corresponding to the proportion of services already provided up to the time you notified us of the exercise of the right of withdrawal in respect of this contract compared to the total scope of the services provided for in the contract.

Allgemeine Geschäftsbedingungen der Firma Eclectic Handcrafts by Claudia

§1 Geltung gegenüber Unternehmern und Begriffsdefinitionen

(1) Die nachfolgenden Allgemeinen Geschäftbedingungen gelten für alle Lieferungen zwischen uns und einem Verbraucher in ihrer zum Zeitpunkt der Bestellung gültigen Fassung.

Verbraucher ist jede natürliche Person, die ein Rechtsgeschäft zu Zwecken abschließt, die überwiegend weder ihrer gewerblichen noch ihrer selbständigen beruflichen Tätigkeit zugerechnet werden können (§ 13 BGB).

§2 Zustandekommen eines Vertrages, Speicherung des Vertragstextes

(1) Die folgenden Regelungen über den Vertragsabschluss gelten für Bestellungen über unseren Internetshop http://www.eclectic-handcrafts.de.

(3) Die Präsentation der Waren in unserem Internetshop stellen kein rechtlich bindendes Vertragsangebot unsererseits dar, sondern sind nur eine unverbindliche Aufforderungen an den Verbraucher, Waren zu bestellen. Mit der Bestellung der gewünschten Ware gibt der Verbraucher ein für ihn verbindliches Angebot auf Abschluss eines Kaufvertrages ab.

(4) Bei Eingang einer Bestellung in unserem Internetshop gelten folgende Regelungen: Der Verbraucher gibt ein bindendes Vertragsangebot ab, indem er die in unserem Internetshop vorgesehene Bestellprozedur erfolgreich durchläuft.
Die Bestellung erfolgt in folgenden Schritten:
  • Auswahl der gewünschten Ware
  • Bestätigen durch Anklicken der Buttons „Bestellen“
  • Prüfung der Angaben im Warenkorb
  • Betätigung des Buttons „zur Kasse“
  • Anmeldung im Internetshop nach Registrierung und Eingabe der Anmelderangaben (E-Mail-Adresse und Passwort).
  • Nochmalige Prüfung bzw. Berichtigung der jeweiligen eingegebenen Daten.
  • Verbindliche Absendung der Bestellung durch Anklicken des Buttons „kostenpflichtig bestellen“ bzw. „kaufen“
Der Verbraucher kann vor dem verbindlichen Absenden der Bestellung durch Betätigen der in dem von ihm verwendeten Internet-Browser enthaltenen „Zurück“-Taste nach Kontrolle seiner Angaben wieder zu der Internetseite gelangen, auf der die Angaben des Kunden erfasst werden und Eingabefehler berichtigen bzw. durch Schließen des Internetbrowsers den Bestellvorgang abbrechen. Wir bestätigen den Eingang der Bestellung unmittelbar durch eine automatisch generierte E-Mail („Auftragsbestätigung“). Mit dieser nehmen wir Ihr Angebot an.
(5) Speicherung des Vertragstextes bei Bestellungen über unseren Internetshop : Wir speichern den Vertragstext und senden Ihnen die Bestelldaten und unsere AGB per E-Mail zu. Die AGB können Sie jederzeit auch unter http://www.eclectic-handcrafts.de einsehen. Ihre vergangenen Bestellungen können Sie in unserem Kunden-Bereich unter Mein Konto –> Meine Bestellungen einsehen.

§3 Preise, Versandkosten, Zahlung, Fälligkeit

  1. Die angegebenen Preise enthalten die gesetzliche Umsatzsteuer und sonstige Preisbestandteile. Hinzu kommen etwaige Versandkosten.
  2. Der Verbraucher hat die Möglichkeit der Zahlung per Vorkasse, PayPal, Kreditkarte( Visa, Mastercard ) .
  3. Hat der Verbraucher die Zahlung per Vorkasse gewählt, so verpflichtet er sich, den Kaufpreis unverzüglich nach Vertragsschluss zu zahlen.

§4 Lieferung

(1) Sofern wir dies in der Produktbeschreibung nicht deutlich anders angegeben haben, sind alle von uns angebotenen Artikel sofort versandfertig. Die Lieferung erfolgt hier spätesten innerhalb von 5 Werktagen. Dabei beginnt die Frist für die Lieferung im Falle der Zahlung per Vorkasse am Tag nach Zahlungsauftrag an die mit der Überweisung beauftragte Bank und bei allen anderen Zahlungsarten am Tag nach Vertragsschluss zu laufen. Fällt das Fristende auf einen Samstag, Sonntag oder gesetzlichen Feiertag am Lieferort, so endet die Frist am nächsten Werktag.

(2) Die Gefahr des zufälligen Untergangs und der zufälligen Verschlechterung der verkauften Sache geht auch beim Versendungskauf erst mit der Übergabe der Sache an den Käufer auf diesen über.

§5 Eigentumsvorbehalt

Wir behalten uns das Eigentum an der Ware bis zur vollständigen Bezahlung des Kaufpreises vor.

§6 Widerrufsrecht des Kunden als Verbraucher Widerrufsrecht für Verbraucher

Verbrauchern steht ein Widerrufsrecht nach folgender Maßgabe zu, wobei Verbraucher jede natürliche Person ist, die ein Rechtsgeschäft zu Zwecken abschließt, die überwiegend weder ihrer gewerblichen noch ihrer selbständigen beruflichen Tätigkeit zugerechnet werden können:

Wenn Sie diesen Vertrag widerrufen, haben wir Ihnen alle Zahlungen, die wir von Ihnen erhalten haben, einschließlich der Lieferkosten (mit Ausnahme der zusätzlichen Kosten, die sich daraus ergeben, dass Sie eine andere Art der Lieferung als die von uns angebotene, günstigste Standardlieferung gewählt haben), unverzüglich und spätestens binnen vierzehn Tagen ab dem Tag zurückzuzahlen, an dem die Mitteilung über Ihren Widerruf dieses Vertrags bei uns eingegangen ist. Für diese Rückzahlung verwenden wir dasselbe Zahlungsmittel, das Sie bei der ursprünglichen Transaktion eingesetzt haben, es sei denn, mit Ihnen wurde ausdrücklich etwas anderes vereinbart; in keinem Fall werden Ihnen wegen dieser Rückzahlung Entgelte berechnet.
